Mika Brzezinski was absolutely beaming with pride as her Morning Joe co-host Joe Scarborough thoroughly humiliated Senator Ted Cruz (R-Texas) on Wednesday.
The debate over AR-15s has been heated since the Parkland school shooting last month. Republicans, backed by the National Rifle Association are resisting calls to ban assault weapons and they are using every trick in the book to do excuse doing nothing to prevent these weapons from getting in the wrong hands.
One of the arguments that Ted Cruz pitched on Morning Joe is that deer rifles are just as deadly as an AR-15, a weapon that was literally designed for the military to kill enemies on the battlefield.
“Your argument here is that deer rifles are just as lethal?” Scarborough replied. “If somebody takes a deer rifle into a high school in Parkland, that deer rifle is going to be as lethal as an AR-15?”
The AR-15 is not only useless as a hunting rifle, it’s too much firepower for home defense since rounds can penetrate walls and can innocents on the other side of them. It’s also less mobile because it’s a long gun.
Unable to defend his argument, Cruz resorted to talking about the Second Amendment and claiming that the Constitution protects ownership of AR-15s.
Scarborough, who is also a lawyer, didn’t buy the bullsh*t Cruz was trying to sell him.
“But you know, though, every American doesn’t have a constitutional Second Amendment right to carry an AR-15 — yes or no?” Scarborough pressured Cruz.
“I’m not gonna debate that,” Cruz said. Instead, Cruz said that it was up to the courts to decide. Scarborough groaned in frustration and pointed out that courts have already decided.
“Senator, there are a lot of lawyers rolling their eyes at what you’re saying because this percolation has been going on for 10 years,” he said.
Cruz then switched to using his experience arguing in front of the Supreme Court to lecture Scarborough, and that didn’t go very well.
“I don’t need you to lecture me on what the Supreme Court does and what it doesn’t do,” Scarborough fired back. “If the Supreme Court denies cert time and time again, and they have since 2010, and they’ve allowed Connecticut’s laws to stand in place that actually bans assault-style weapons. Right now, the court is sitting back and allowing that to stay in place, and allowing that — that is constitutional right now. There is not a constitutional right, and you know it. And you can talk down to me all you want to, but you know there is no constitutional-”
Cruz cut Scarborough off momentarily but he quickly resumed taking Cruz to the woodshed.
“Even a dumb country lawyer like me understands that an AR-15 today is not recognized as a constitutional right of Americans under the Second Amendment,” he said.
Cruz then tried to argue that the Supreme Court ruled in Columbia v. Heller that Americans can own AR-15s, which is strange because the late-conservative Justice Antonin Scalia wrote the majority opinion in that case.
“Like most rights, the right secured by the Second Amendment is not unlimited,” Scalia wrote, adding that it is “not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.”
In short, we can ban assault weapons.
Scarborough then slammed Cruz for living in a fantasy world, because if the Supreme Court, in fact, had made such a ruling they would be accepting challenges to assault weapons bans. But they are not doing any such thing. As Scarborough previously mentioned, the high court is denying certs, which is short for certiorari, a writ the Court grants or denies when considering cases to hear.
“You are talking about what you want the law to be, I’m talking about what the law is,” Scarborough said.

If Ted Cruz thought he could just appear on Morning Joe and shove NRA talking points down everyone’s throats, he seriously underestimated Joe Scarborough’s legal background and knowledge of the subject matter.
All Cruz could do is smile as his argument was obliterated over and over again. But it was clear that he was desperate to defend assault weapons like the NRA paid him to do. They didn’t get their money’s worth.
