Fresh off of being shunned by his friends on Martha’s Vineyard for being a complete prick, Alan Dershowitz appeared on Fox News Friday night and claimed that the announcement of indictments against 12 Russian intelligence officers proves that a special counsel was never needed.
On Friday, Special Counsel Robert Mueller indicted the Russian intelligence officers as part of his investigation into Russian interference with the 2016 Election, adding to a long list of indictments and guilty pleas that he has secured since being appointed to lead the probe in May 2017.
But Trump’s allies are using the latest indictments an yet another excuse to call for ending the investigation.
That’s exactly what Dershowitz did when asked about the indictments:
“Well, you know it proves — this indictment proves that we never needed a special counsel,” Dershowitz began.
“This indictment could have been brought by ordinary prosecutors, ordinary FBI agents. There’s no conflict here. It’s Russians they are going after. There is no president; There’s no people around the president; There’s no conflict between the attorney general, the deputy attorney general and Americans — It’s all Russians. Why do we need to spend 20, 30, 40 million dollars, have special counsel appointed to do a routine national security investigation? Number one.
Number Two, we will never find out the extent of the guilt of these people because, of course, they are never going to go on trial. They are indicted. Do you think the Russians are going extradite them? Do you think they’re going travel to the United States to Disneyland to get arrested? Of course that’s not going to happen. So, it will be the end of the process. And indictments are just one-sided allegations. They are not proof.”

If Mueller had not been named special counsel, these indictment never would have happened. Trump, nor Republicans in Congress, wanted this investigation. They wanted to ignore the reports of our intelligence community and pretend Russian interference had never happened. Just ask Trump, who still claims Russia didn’t attack our democracy.
Furthermore, we can discover the extent of their guilt because the investigation is ongoing. There are still plea deals to be made, witnesses to come forward, and evidence to find. Investigators can do a lot without having to talk to those being investigated.
Also, it should be pointed out that it’s not just Russians that Mueller is going after. Many Americans have been ensnared by this investigation, including people around Trump. Former National Security Adviser Michael Flynn took a plea deal. So did Trump campaign officials George Papadopoulos and Rick Gates. Trump’s former campaign manager Paul Manafort is currently sitting in jail awaiting trial. And his former personal attorney Michael Cohen is also awaiting trial and could be getting ready to talk to prosecutors in exchange for a deal because Mueller referred evidence against Cohen to federal prosecutors in New York.
That’s a lot of people “around the president” who have been caught up in this investigation. And if Trump and Republicans had their way, none of it would have happened. But Deputy Attorney General Rod Rosenstein appointed Mueller as special counsel, we know more about Trump’s involvement with Russia and the 2016 Election meddling than we would have ever known. And let’s not forget that the reason Mueller was appointed in the first place is because Trump fired former FBI Director James Comey for not dropping the investigation.
Clearly, a special counsel was needed.
